SC Highlights Misuse of Women Protection Laws Amid Rising Cases

Key Comments of SC on Misuse of Women Protection Laws:

The Supreme Court of India advised women not to misuse stringent laws meant for their protection against harassment by in-laws. These laws are intended for safeguarding women, not for using them as weapons against husbands. The court emphasized that marriage is not a commercial venture, and maintenance claims during divorce should be reasonable, ensuring that ex-husbands are not financially ruined.

Justice Nagarathna made these significant remarks on Thursday while delivering a verdict in a divorce-related case.

The court clarified that maintenance is meant to support a wife who relied on her husband after marriage, ensuring she doesn’t face hardships post-divorce.

However, maintenance should not match the ex-spouse’s financial status but should be determined based on social conditions and lifestyle.

The remarks gained importance following the recent suicide of Bengaluru techie Atul Subhash, reportedly driven by alleged harassment, excessive maintenance demands, and false legal cases.

His suicide note and selfie video sparked nationwide discussions. Social media debates have highlighted the growing instances of men being harassed under laws intended for women’s welfare.
